RE: The tariff classification of bicycle chain wheels or chain rings from Taiwan and China

Dear Mr. Phillips,

In your letter dated July 29, 2010, you requested a tariff classification ruling.

The items under consideration have been identified as aluminum or steel BMX Bicycle Chain Wheels; these items can also be referred to as Chain Rings. The Wheel shown in your included photograph is 20" in diameter and is used on a single-speed bicycle. The Wheels are attached to the bicycle cranks and then to the bicycle frame with a chain going around the Wheel to propel the bicycle. Sizes of Wheels commonly range from 22 to 45 teeth. The weight of one Wheel can range from 2oz to 8oz depending on material, design and size.

The applicable classification subheading for the BMX Bicycle Chain Wheels or Chain Rings will be 8714.96.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Parts … of [bicycles]: … crank-gear, and parts thereof: Other crank gear and parts thereof.” The rate of duty will be 10%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
